Nishchit places automated confirmation calls on a merchant’s behalf. The merchant decides who is called and is responsible for having the right to call them; Nishchit is responsible for the platform behaving as described and for never recording an agreement that was not given.
The agreement
These terms are between [registered company name] and the organisation that opens a Nishchit account. Using the platform accepts them. [State the governing law and the forum for disputes.]
What the platform does
Nishchit ingests orders from a merchant’s store or API, telephones the customer on each order, holds a conversation in the language the merchant configured, and records a structured outcome with a recording and a transcript.
Nishchit does not take payments, does not deliver parcels and does not act as a courier. Money changes hands between the customer and whoever delivers.
What a merchant is responsible for
Placing an automated call to somebody is a decision the merchant makes, and the merchant makes it about their own customers.
- Having a lawful basis to telephone the numbers they upload
- The accuracy of the orders and phone numbers they send
- Honouring a customer’s request not to be called again
- What their agents are configured to say, and the brand name the agent uses
- Keeping their team’s access and roles current
Acceptable use
Nishchit is for confirming and servicing orders the merchant has received.
- No cold calling, marketing campaigns or unsolicited outreach
- No calls to numbers the merchant did not obtain from their own customer
- No configuring an agent to claim it is a human being
- No attempt to reach another organisation’s orders, calls or recordings
Demo mode
An organisation in demo mode places no real calls and is billed no minutes. Every screen in demo mode is marked. An order is never recorded as confirmed in demo mode as though it were a real confirmation.
What Nishchit does not promise
The agent is software having a conversation over a telephone network, and both of those fail sometimes. Calls will go unanswered, lines will be busy, and some conversations will end unresolved or escalated rather than confirmed.
Nishchit does not promise a confirmation rate, a call-completion rate or an outcome distribution, and publishes no such figure. What it does promise is that an order is not recorded as confirmed unless agreement was actually reached in the call.

Fees

Suspension and termination
Either party may end the agreement [notice period]. Nishchit may suspend an account that is using the platform for the calling this document prohibits. On termination a merchant may export their orders, recordings and transcripts for [export window] before deletion.
